BomboCart is a Shopify application that automatically sends SMS reminders to customers who abandon their checkout process, helping store owners recover lost sales.

3. Account Registration and Requirements

3.1 Shopify Store Requirement

You must have an active Shopify store to use BomboCart.

3.2 Compliance Requirements

You must:

• Have a valid privacy policy that discloses the use of SMS marketing
• Obtain proper consent from customers before collecting their phone numbers
• Adhere to all applicable laws regarding SMS marketing and data privacy

4. SMS Credits and Billing

4.1 Credit System

• We operate on a pay-as-you-go model using SMS credits
• 25 free credits are provided upon signup
• Additional credits can be purchased through the app

4.2 Refunds

• Credits are non-refundable once purchased
• We may issue refunds at our discretion for service outages or technical issues

5. User Conduct and Restrictions

You agree not to:

• Violate any laws or regulations
• Infringe upon intellectual property rights
• Send unsolicited messages to individuals who have not consented
• Use the service for any harmful or fraudulent purpose
• Attempt to reverse-engineer the application

6. Compliance with SMS Regulations

6.1 Your Responsibilities

You are responsible for:

• Obtaining proper consent before collecting phone numbers
• Maintaining records of customer consent
• Honoring opt-out requests
• Complying with all applicable telemarketing laws and regulations

6.2 Prohibited Content

SMS messages must not contain:

• Offensive or inappropriate content
• Misleading or false information
• Content that violates any law or regulation

All content, features, and functionality of BomboCart are owned by us and are protected by copyright, trademark, and other intellectual property laws.

8. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues.

9. Indemnification

You agree to indemnify and hold harmless BomboCart and its officers, directors, employees, and agents, from and against any claims, disputes, demands, liabilities, damages, losses, and expenses.

10. Termination

We reserve the right to suspend or terminate your access to BomboCart for violations of these Terms or for any other reason at our sole discretion.

11. Changes to Terms

We may modify these Terms at any time. Continued use of BomboCart after any such changes constitutes your acceptance of the new Terms.
